Property Owners in Orange County Await an Explanation
On Monday, October 4, 2021, Governor Gavin Newsom declared a state of emergency for Orange County as efforts to control and clean up the oil spill continued. The oil spill came from a pipeline connected to an oil platform named Elly, owned by Amplify Energy of Houston. Divers from Amplify Energy have searched around 8,000 feet of the burst pipeline as of Tuesday morning to determine the cause of the spill. The entire pipeline extends for 17 miles from the Port of Long Beach to the processing platform, which is located about 6 miles offshore in federal waters.
Early reports have stated that the pipeline responsible for the oil spill appears bent and split on underwater cameras, as well as displaced on the seafloor by about 105 feet. The CEO of Amplify Energy announced during a news conference that divers had found a specific area of significant interest that they were investigating further. When asked if the spill could have been caused by a ship’s anchor, the CEO said that this was a distinct possibility. However, they have yet to confirm the cause of the spill.
Meanwhile, Orange County’s District Attorney, Todd Spitzer, is calling for an investigation by law enforcement officials rather than divers hired by the energy company, citing that Amplify Energy’s goal is to protect itself from liability rather than to bring justice to all of those impacted by the oil spill. Amplify Energy does have a pattern of violating safety rules and just emerged from bankruptcy four years ago. If the company is found to be responsible for the oil spill, it will be held accountable for victims’ related financial losses under federal law, including property damage.
What Financial Compensation is there for Oil Spill Property Damage?
Crude oil is extremely dangerous for everyone in the affected area. An oil spill in the ocean can be devastating for marine and wildlife. It can also cause health problems for those swimming in the water or even living in the immediate area – anyone who touches the oil or inhales its vapors. In addition, crude oil can cause significant property and environmental damage, including damage to:
- Homes
- Rental Properties
- Landscaping and beaches
- Businesses
- Commercial property
- Real estate
- Hotels and motels
- Restaurants and bars
- Boats
- Personal watercraft
- Docks and piers

Most property insurance policies will cover damage caused by an oil spill. Our attorneys at Bentley & More LLP can help you understand all of your legal options for financial recovery. You may be eligible for compensation for your property repairs, destroyed property, the diminished value of your property after the oil spill, business losses, injuries to pets and more.
