Another Victory for Bentley & More and Ironworker!
Keith More of Bentley & More LLP does it again!
Our client, after falling from a building, sustained catastrophic injuries resulting in quadriplegia. After spending over one year in a rehabilitation facility, it was time for him to return to his wife and daughter. But the insurance company did not want to buy a new home for the client. Instead, the insurance company wanted to modify his existing home. This was not in the best interest of our client. In fact, after a complete analysis of the home, it was determined that his house could not be modified properly.
Mr. More argued that our client was entitled to a home in lieu of the rehabilitation facility. He also argued for the square footage and modifications necessary to ensure safe living for our client and his family. It is this knowledge as to the needs of his clients that provides a distinct advantage for BMG clients.
Since our client is an ironworker the case must be heard by an arbitrator. After 6 hours of arbitration, the arbitrator issued his findings and awarded the purchase of the home of similar value per square foot as the home our client was living in before his accident occurred.
Yesterday, the wire transfer had to be made for the deposit. Unfortunately, the insurance company could not get the money wired. Rather than have the client lose the home, Mr. More advanced the $10,000 for his clients.
Mr. More stated, “The joy that my clients felt upon receiving notification that the deposit had been made was incredible. They now will be reunited as a family. It is our hope that the closing on the house will occur within 30 days and we can begin construction on the modifications.”
